    Miller v. Kia Canada Inc.

    False representations regarding the power of engines

    On December 9th 2003, Mr. Paul Miller filed a motion for authorization to institute a class action against Kia Canada Inc. This class action is jointly led by the firms of TRUDEL JOHNSTON & LESPÉRANCE and BELLEAU LAPOINTE.

    The Applicant alleges that the Respondent exaggerated the horsepower of the Kia Magentis 2001 and 2003. The Applicant is seeking compensation and punitive damages.

    On September 9th 2003, Judge Wilbrod Claude Décarie of the Superior Court authorized the class and described the group as follows:

    All natural persons, legal persons established for private interests, partnerships and associations who, in Quebec, purchased or rented for a long term a Kia Magentis 2001 and 2002, the actual power of which is inferior to the power represented by Kia Canada Inc.

    On December 11th 2003, the Plaintiff filed his motion to institute proceedings. The hearing of the present case should take place in the coming months.

    In this case, a settlement was reached between the parties. The claim period is now finished.
