Victims of sexual assault and/or harassment by Gilbert Rozon
The action claims just compensation for the victims, but also an award of truly exemplary punitive damages in order not only to punish the perpetrator and deter similar behavior, but to signify the intensity with which our society denounces such behavior.
On August 15, the Honourable Mr. Justice Schrager of the Court of Appeal allowed Rozon to appeal the judgment of the Superior Court authorizing the class action. Rozon will challenge the authorization of the class action before three judges of the Court of Appeal in the beginning of 2019.

The class action
On November 27, 2017, the non-profit association Les Courageuses filed an application to be authorized to bring a class action on behalf of the victims of Gilbert Rozon.
In a detailed judgment, the Honourable Justice Donald Bisson confirms that the terms “sexual predator” and “rape” refer to factual allegations that Les Courageuses have the right to use to describe Mr. Rozon and his actions. The judge therefore denied Mr. Rozon’s application to strike out portions of the application for leave to institute a class action. This is a significant victory for Les Courageuses and the members of the group.
The motion to strike covered three categories of allegations:
1. those where “sexual predator” was used to describe him,
2. those where the term “rape” was used to describe his actions, and,
3. those stating that certain charges were withdrawn in 1998 and that an investigation was ongoing currently.
Judge Bisson’s conclusions are that these passages are relevant to the class action. He adds that Rozon’s motion to strike seeks to remove the core of the factual allegations in the Motion, which the Court cannot do.
On May 22, 2018, one week after the hearing of the application for authorization to institute a class action, the Honourable Justice Donald Bisson authorized a class action by Les Courageuses against Gilbert Rozon.
