This class action seeks to compensate Quebec residents who bought an airplane ticket at a price higher than what was announced on Air Canada’s website between June 30, 2010, and February 8, 2012.

Concurrently, a Settlement Conference was held on February 15, 2021 with Air Canada, but no settlement was reached.
Conditions to be part of this class action
You are part of the class action if you meet all of the following criteria:
-You purchased a ticket between June 30, 2010, and February 8, 2012;
-The purchase was made on Air Canada’s website;
-You lived in Quebec at the time of the purchase;
-You paid a price higher than the price originally announced (excluding taxes and government fees).
YOU ARE NOT AFFECTED BY THIS CLASS ACTION IF you are a merchant who purchased an airplane ticket for the purposes of your business.
Summary of the class action
Air Canada’s website offers the opportunity to purchase airplane tickets for different destinations, departing from different airports.
Since June 30, 2010, the Consumer Protection Act stipulates that the announced price must include the total amount that the consumer will have to pay, excluding taxes and government fees.
Between June 30, 2010, and February 8, 2012, the price displayed at the first stage of purchase on Air Canada’s website was not the total price. Several fees were added in the next step, in violation of the Consumer Protection Act.
On July 16, 2010, the Union des consommateurs and Mr. Silas filed an Application for authorization to institute a class action and to be a representative.
On August 24, 2012, the Superior Court dismissed the authorization of the class action.
On March 7, 2014, the Quebec Court of Appeal authorized the class action.
On October 2, 2014 the plaintiff filed the Originating Application.
On July 3, 2015, Air Canada filed its Defence.
In December 2017 and February 2018, two Air Canada representatives answered a written examination. In June 2018, an Air Canada representative answered a request for clarification following the answers previously obtained.
The complete file declaration was filed on November 23, 2020. We are therefore awaiting trial dates.
