Christopher Zakem v. Rogers Communications Canada inc.

Late fees of 42.58% charged by ROGERS, FIDO, CHATR AND WOW!

    The Cause

This class action lawsuit seeks to compensate Rogers, Fido, Chatr and WOW! customers who have paid late fees since March 1, 2019.

Late fees charged on bill balances since that date are calculated at an annual interest rate of 42.58%, which is a monthly interest rate of 3%, compounded daily, on balances still outstanding on the bill due date.

On February 17, 2020, the plaintiff filed a motion to institute a class action, asking the defendant to reduce its interest rate from 42.68% to 15% and to make reparation for the harm it has caused to its customers. The plaintiff is also claiming punitive damages against Rogers in view of the abusive nature of the interest rate charged to its customers, in violation of the Consumer Protection Act.
