Unilateral modification to a pension plan
On October 7, the application for authorization was presented to the honourable judge Suzanne Courchesne who has taken the matter under advisement. Once the judgment is rendered, it will be posted on this page and an email will be sent out to people who have registered with us.
Authorization is a key step since a class action cannot proceed without this authorization from the Superior Court.
The class action
In November 2018, Yvon Milliard filed an application for authorization to institute a class action and obtain the status of representative against Kraft Heinz Canada ULC, the successor of Kraft Canada Inc.
The class action seeks compensation for the bridge benefit that the class members lost as a result of Kraft’s illegal unilateral amendment.
Conditions to be part of this class action
The class action’s group is described as follows:
“All participants in Option 2 of the pension plan of Non-Unionized Hourly-Paid Employees of Kraft Canada Inc. – bulk cheese plant and Mont-Royal plant, which have not received the value of their bridge benefit. “
