    Billette v. Groupe Dumoulin électronique Inc.

    Illegal publicity of consumer credit

    On August 7th 2002, Ms. Claire Billette filed a motion for authorization to institute a class action against Groupe Dumoulin électronique Inc.

    The class action alleges that Dumoulin intentionally violated certain provisions of the Consumer Protection Act through its publicity of consumer credit. Ms. Billette seeks the reimbursement of financing fees paid by consumers, damages and punitive damages.

    On September 5th 2003, Judge Clément Gascon of the Superior Court authorized the institution of the class action and described the group covered as follows:

    All natural persons residing in Quebec who, since August 7th 1999, purchased a movable good from the Respondent through a financing program providing for the payment of equal installments with no fees or interests and advertised by the Respondent such as “equal installments no fees nor interests” or as “financing up to 24 or 36 months no interests”

    On February 16th 2004, the Plaintiff filed her motion to institute proceedings. The trial of the case will be heard on October 5th, 6th, 7th, 11th and 12th 2005.
