    The claim period is now open following the online publication of the post-approval notices for the settlement agreement on November 17, 2025. You can read the French notice here, and its Spanish translation here. 

    To submit a claim, please complete the form provided for this purpose here on the Proactio website, the independant administrator responsible for managing claims and distributing compensation to eligible members.  

    If you have not received any notices or communications from Proactio but believe you are a member of the class action, you may still file a claim. Proactio will determine your eligibility.  

    The class action

    The plaintiff, a public interest organization representing immigrant workers, has filed a class action against an immigration and employment agency operating under the name “Trésor” and against Newrest, a multinational company that provides catering services to over 30 airlines in Canada, including at the Montreal-Trudeau International Airport. 

    The class action seeks justice for hundreds of migrant workers who were victims of by an illicit scheme  by the defendants, who induced them to work under the false promise of a valid Canadian work permit. 

    Taking advantage of the group members’ vulnerability and precarious immigration status, the defendants exploited them for profit, thereby infringing their fundamental rights as protected by the Quebec Charter. The Centre is claiming moral and punitive damages for all members of the group. 

    The application for authorization was filed on October 3, 2023. On September 27, 2024, the plaintiff filed a motion for leave to amend the application for authorization to institute a class action. The amended application included the addition of:  

    additional defendants who contributed to the exploitation system of the workers;  

     relevant facts that occured after the filing of the application for authorization, in particular with regard to the end of Tresor activities,             the campaign to regularize the migratory status of class members and the agreement reached between the plaintiff and the Newrest                 defendants; and  a cause of action against Newrest for its refusal to abide by the agreement reached with the plaintiff.  

    On October 23, 2024, the court allowed the plaintiff to amend its application for authorization. The amended application for authorization can be read here.     On May 8, 2025, after several rounds of negotiations, the parties came to a global settlement agreement in order to settle the class action. The plaintiff therefore filed to the court a motion for permission to modify the authorisation motion for settlement and for approval of the notices to members. You can consult the motion (in French only), here. This motion was granted on May 9, 2025. 

    On September 19, 2025, the Honorable Catherine Piché of the Superior Court issued her judgment approving the settlement agreement reached between the parties. You can read the judgment here and the settlement agreement here (French version) and the spanich translation here

    Criteria 

    You could be part of the class action if you belong to the group as recognized by the Superior Court. The criteria for membership are as follows:

      • You worked without a valid Canadian work permit, specifically in Newrest’s production units in Montreal OR you are the heir of someone who meets this criterion; 
      • Between October 3, 2020, and May 7, 2025. 
      • After being placed or paid by one of the agencies or individuals mentioned in the notice (Gestion Trésor Inc., l’Agence de Placement Trésor Inc., Emploi Trésor International Inc., Trésor (9475-0635 Québec Inc.), 9441-1550 Québec Inc., 9278-9627 Québec inc., 9371-8914 Québec inc., 9380-8178 Québec inc., Succès Canada Immigration inc. or Mr. Guillermo Montiel Villalvazo). 

    IF YOU DO NOT WISH TO PARTICIPATE IN THIS CLASS ACTION

    The period to opt out of the class action expired on August 21, 2025. Notices were sent for that purpose in order to give members time to submit an exclusion request if they wished to do so. It is therefore no longer possible to formally opt out of the class action. 

    However, you are under no obligation to claim your compensation.
