The Court of Appeal rendered an important judgment ordering Imperial Tobacco and Rothmans, Benson & Hedges to furnish security in an amount close to 1 billion dollars.
The security will be furnished by way of quarterly instalments starting at the end of December in the amounts of $ 108,3 million for Imperial Tobacco and $ 37,7 million for Rothmans, Benson & Hedges
Justice Mark Schrager found that “it is not acceptable that Appellants merely say that they have no funds to satisfy the judgment or an order to furnish security and continue to distribute earnings because that it is ‘business as usual’. […] Continuing the practice of distributing earnings out-of-jurisdiction at this point is at best disingenuous and at worst, bad faith.”
