Misleading Advertisements – Fruit and vegetable juices
The class
On May 20, 2016, Ms. Louise Rivard filed a motion seeking authorization to institute a class action against A. Lassonde Inc., Lassonde Industries Inc. and Campbell Company of Canada pursuant to the Consumer Protection Act (“CPA”) and the Competition Act. The plaintiff was notably concerned with changing the behaviour of defendants.
The plaintiff, following TJL’s recommendation, has decided to withdraw from the class action as it has become moot. Indeed, Canada’s Food Guide was being revised (which has since been completed) and there is a public debate surrounding the federal Bill S-228, which seeks to regulate advertising directed at children.
The defendants A. Lassonde inc. and Industries Lassonde inc. have voluntarily decided to refrain for a certain period of time from using the Disney characters as a result of the release of their stock of preprinted containers that will exist at the termination of the Disney contract.
