    Lenzi v. Apple Canada Inc.

    Apple iPod/Duration of battery life

    On June 7th 2005, Ms. Ines Lenzi filed a motion for authorization to institute a class action against Apple Canada with regards to the duration of her iPod’s battery life.

    The Applicant alleges that Apple falsely represented the duration of its iPod’s battery life and misled consumers by not informing them of the fact that the life of the battery can substantially diminish after a certain lapse of time.

    The group covered by the class action sought is as follows:

    All persons residing in Quebec and who own an iPod of the first, second or third generation, the battery life of which is inferior to that represented by the Respondent or has substantially diminished.

    On February 1st, 2006, the Honourable Justice Danielle Richer dismissed the motion to authorize a class action. The Applicant has appealed that decision.
