On October 3, 2023, the applicant, the Immigrant Workers’ Centre, filed an application for authorization of a class action.
The class action
The plaintiff, a public interest organization representing immigrant workers, has filed a class action against an immigration and employment agency operating under the name “Trésor” and against Newrest, a multinational company that provides catering services to over 30 airlines in Canada, including at the Montreal-Trudeau International Airport.
The class action seeks justice for hundreds of migrant workers who were victims of by an illicit scheme by the defendants, who induced them to work under the false promise of a valid Canadian work permit.
Taking advantage of the group members’ vulnerability and precarious immigration status, the defendants exploited them for profit, thereby infringing their fundamental rights as protected by the Quebec Charter. The Centre is claiming moral and punitive damages for all members of the group.

Criteria
You could be part of the class action if you are part of the group described below:
Any person who has worked, for any length of time, under the direction or control of the immigration and employment agency operating under the name “Trésor” without a valid work permit.
Sub-group: Any person belonging to the group who has worked, for any length of time, in a Newrest production unit without a valid work permit.
Toute personne qui a travaillé, quelle que soit la durée, sous la direction ou le contrôle de l’agence d’immigration et d’emploi opérant sous le nom de « Trésor » sans permis de travail valide.
Sous-groupe : Toute personne faisant partie du groupe qui a travaillé, quelle que soit la durée, dans une unité de production de Newrest sans permis de travail valide.
