On September 28, 2026, the Plaintiff filed an application for authorization to institute a class action against Driscoll’s Canada Operations Inc. and Driscoll’s Inc. before the Superior Court of Quebec.
The class action
The class action alleges that Driscoll’s sold strawberries, raspberries, blackberries and blueberries in Canada that contained pesticide residues or other chemical substances exceeding the applicable regulatory thresholds. According to the application for authorization, the defendants were reportedly informed of compliance issues with these limits as early as 2022 and nevertheless continued selling their products while failing to inform consumers.
The application further argues that consumers had no way of knowing that the fruits they were purchasing might contain substances exceeding permitted limits. Rather, they could reasonably expect the products to comply with Canadian food safety regulations. The complaint also raises the issue of the company’s misleading representations regarding the quality, food safety, and compliance of its products.
The action seeks:
- A reduction in the price paid for the affected products;
- Punitive damages

All natural persons who purchased Driscoll’s brand berries (strawberries, raspberries, blackberries or blueberries) in Quebec since January 1, 2022.
