    Labonté v. Voyageur Marine Transport Limited

    Users of Saint-Louis-de-Gonzague bridge

    On June 12, 2008, Mrs Claudia Labonté filed a Motion in the Quebec Superior Court, District of Beauharnois, to be authorized to exercise a class action against Voyageur Maritime Transport Limited. T & J is acting in collaboration with the firm Lauzon Bélanger Lespérance in this file.

    The class is defined as follows:

    All physical and moral persons and their heirs and successors, users of the St-Louis-de-Gonzague bridge, who were deprived of the use of said bridge between June 13, 2006 and December 8, 2006 inclusively.

    and

    All physical and moral persons and their heirs and successors, users of the St-Louis-de-Gonzague bridge, who in the context of their commercial activities suffered damages following the closure of the St-Louis-de-Gonzague bridge between June 13, 2006 and December 8, 2006 inclusively.

    The procedure alleges that the members of the group were deprived of the use of the Saint-Louis de Gonzague bridge due to the negligence of Voyageur Maritime Transport Limited whose ship collided with the bridge in question and that they are collectively entitled to seek compensation for the damages they have suffered.

    In a judgment issued on May 3, 2011, Madam Justice Courville dismissed the Motion for authorization. The applicant has filed his inscription in appeal on June 2nd.
