T & J won a class action on the merits which established the liability of Montreal’s blue collar workers Union and of the City of Montreal for their combined failure to de-ice the sidewalks of the city center as a result of illegal pressure tactics. The Court of Appeal confirmed the liability of the defendants as well as the right to punitive damages.
