    Disciplinary segregation in a provincial institution: a Class Action Application is filed

    George Michael Diggs, represented by Trudel Johnston & Lespérance, filed an Application for Authorization to Institute Class Action on October 1, 2020 regarding the disciplinary segregation of inmates in provincial institutions. This Application is filed against the Attorney General of Quebec (AGQ), representing the Services correctionnels du Québec (“SCQ”).

    The Application alleges that the SCQ is using this drastic sanction of deprivation of liberty regularly, wrongfully and in a discriminatory manner. The Application also alleges that the disciplinary process leading to segregation, also known as reclusion or confinement, does not provide procedural fairness. According to the Application, this practice is wrongful and violates fundamental rights.

    This class action seeks compensatory damages for the prejudice suffered by the members of the group as well as punitive damages for the intentional violation of their fundamental rights.
