Huawei Nexus 6P – Settlement Agreement

A settlement agreement has been reached between Huawei Technologies Canada Co. Ltd., Google LLC and Google Canada Corporation (collectively the “Defendants”) and Mr. Tenzer, the representative in the class action.

The agreement provides that the Defendants will pay a lump sum of $ 550,000. This amount will cover the class members’ compensations, legal fees, lawyers’ fees, taxes and all costs related to the distribution of the class members’ compensations.

Who can get money? All persons who currently own or previously owned a Nexus 6P cellphone bought in the province of Quebec.

How much? If you can prove that you own or owned a Nexus 6P bought in the province of Quebec, you could receive $10. If you can also prove the premature draining of the battery, you could receive up to $260. You could alternatively ask Huawei to replace your cellphone battery during the 6 months following the approval of the agreement by the Superior Court.

A fee of 25% plus tax on the indemnities paid to the class members is asked by TJL as well as the reimbursement of the expenses incurred for this class action.

When? TJL will submit the agreement and their legal fees to the Superior Court on October 28, 2021, at 9:30 in Room 17.09 of the Montreal Courthouse. You can attend the hearing if you wish to. Please inform class counsel if you wish to attend so that they can make the proper arrangements or provide you with an access to the virtual hearing.

How can I submit a claim? If the Court approves the settlement agreement, another notice will be published to inform you of the procedure to follow to prove your claim.

You can consult the notice to class members here.
