    The hearing regarding the Application for authorization to institute a class action will be held on May 22, 2024 (room to be determined).

    On January 30, 2024, the Court rendered a judgment granting in part the Defendant’s Application for authorization to submit relevant evidence, and, authorizing the Defendant to submit his exhibits while asking that certain contents of an exhibit be radiated.

    The class action

    Louise Henry, represented by Trudel Johnston & Lespérance, filed an application for authorization to institute a class action against the Government of Québec regarding strip searches and problems of access to healthcare at the Leclerc prison.

    The plaintiff alleges that the manner in which the Leclerc prison treats the women who are detained there violates their right to integrity, security, dignity, equality, to separate treatment appropriate to their sex and physical and mental condition, to be free from cruel and unusual treatment, contrary to the Canadian Charter of Rights and Freedoms and the Charter of Human Rights and Freedoms. Furthermore, the plaintiff argues that this also constitutes a civil fault under the Civil Code of Quebec.

    The application for authorization was filed on February 23, 2023 and has not yet been heard by the Superior Court.

    This class action seeks damages for the violation of the fundamental rights of the members and compensation for the prejudice they have suffered. The application seeks to put an end to these violations.

    Criteria

    You could be part of the class action if:

    – You have been detained at Leclerc prison since September 6, 2019.

    You may also be eligible for additional damages if:

    – You required healthcare during your incarceration.
