    Injunction against the eviction of the encampment on Notre-Dame Street

    Trudel Johnston & Lespérance has been representing the Mobile Legal Clinic (MLC – Clinique juridique itinérante in French), an organization dedicated to improving access to justice for people experiencing homelessness, since 27 June 2025. Our firm is acting as co-counsel in this matter alongside Me Helena Lamed.

    Latest Updates

    On 30 June 2025, a consent motion between the parties was presented to the Superior Court of Quebec to renew the interlocutory injunction granted on 18 June 2025. This consent motion will have the effect of extending the injunction until 10 July 2025, when the parties will return to court to further advance the case.

    Case Background

    On 5 June 2025, Quebec’s Ministry of Transport and Sustainable Mobility posted eviction notices on trees and tents belonging to about thirty people experiencing homelessness living along Notre-Dame East Street, between Pie-IX Boulevard and St-Clément Street. Given the lack of access to shelter resources and affordable housing, most of the individuals targeted by the eviction notice have nowhere else to go.

    On 10 June 2025, the MLC filed an application for a provisional interlocutory injunction to prevent the eviction of the encampment on Notre-Dame Street. The MLC argued that the eviction, in the absence of alternative accommodations, would constitute an unjustified violation of these individuals’ rights to life, safety, integrity, and liberty, as well as their right to dignity.

    On 18 June 2025, Justice Babak Barin of the Superior Court granted a provisional interlocutory injunction in favor of the MLC, valid until 28 June 2025.

    The Case

    Trudel Johnston & Lespérance is proud to represent the MLC, which seeks to have recognized the right of people experiencing homelessness to shelter outdoors on public land when state or community resources are unavailable or insufficient.

    This case aims to defend the rights to dignity and to life, liberty, and security, as guaranteed by the Canadian Charter and the Quebec Charter, for people experiencing homelessness.
